Introduction
According to Decree 185/99 (Implementation of Directive 97/7/EC on the protection of consumers on distance contracts), the website www.air-parts.com is specialized in selling products, intended for racing radio controlled sailing boats modelling, business to consumer (B2C) and business to-business (B2B).
Identity of the supplier
AA-Parts is a registered trademark of the Individual Company Alberto Spada.
The individual company Alberto Spada, based in Cotignola (Ra) Italy, Corso Sforza, 110 - VAT 02410040394, registered at the Chamber of Commerce of Ravenna REA 199317 is the exclusive dealer of the brand AA-Parts as well as www.aa-parts.com.
The products shown in www.air-parts.com are sold through the private company Alberto Spada. The address of the supplier, for any legal action complying with Decree 185/99, is:

Exports
With this Agreement the Customer (hereafter referred to as HE) undertakes to comply with all Export Laws.
In particular, HE will:
| - | not export products to any country in violation of export laws; |
| - | not export products to countries where a governmental approval or license for export is required, without first obtaining all necessary licenses and permits. |
The Customer acknowledges and guarantees not to be a citizen or resident or domiciled in a country where the export of our products is prohibited by any export regulating law.
Circumstances beyond one's control
AA-Parts will comply and be bound to the contract. AA-Parts will in any case be exempt from any liability in case of delays or failures caused by circumstances beyond its control. In case of delay, AA-Parts will comply to all obligations as soon as reasonably possible.
Jurisdiction and legal venue
The sale contract between the customer and AA-Parts is concluded in Italy and regulated by Italian law. AA-Parts shall attempt to resolve any dispute which may arise in a fast and efficient way. For the solution of civil and criminal litigation arising from the conclusion of this distance sale contract, if the customer is a consumer, the legal venue is that of his residence town Court; in all other cases, it shall be the Court of Ravenna.
Shipping & Delivery
Products are sold ex our premises in Cotignola, Corso Sforza, 110.
Usually shipments are made within 10 working days from ordering, unless to stock availability, for standard products and within the period shown on the product page for custom products (sails, special goosenecks, etc.), through express courier. The shipping cost is shown in the final order in connection with destination, weight and volume of purchased products (the time of delivery is around 3 working days of normal destinations in Italy and 4 working days to destinations abroad normal. Please visit the website of the carrier indicated in the email confirmation of shipping for more detailed information on delivery times). Customers will be informed about delays caused by unavailability of products from the supplier or manufacturer, or circumstances beyond our control, with an e-mail sent to the email address provided when registering.
The customer can track the shipment through the tracking system of delivery of the courier used for shipping (if available) to the address indicated in the email confirmation of the shipment.
At the time of product delivery by the courier, the Customer is required to check:
| - | that the number of packages delivered matches the one shown in the transport document or invoice; |
| - | that the packaging is not altered even with regards to the sealing tapes. |
Any damage or the mismatch in the number of packages shall be immediately notified to the courier who delivers.
Important Notice: Once the delivery slip is signed, the customer can not make any objection about the appearance of the goods.
Should the Customer find any tampering, damage to the package and / or breakage, shall immediately challenge the shipment and / or the delivery by writing on the courier delivery slip the words "subject to control commodity." Must then report any damage no later than 7 days from receipt of goods as set forth by the shipment and / or delivery operator. Should the Customer fail to collect the ordered goods, (in storage at the courier warehouses), within 5 working days because of the repeated inability to deliver to the address stated by the customer, the order will be cancelled and shipping and / or storage costs will be charged. For every order placed on www.a-parts.com, Alberto Spada will issue and send an invoice to the Customer to the provided e-mail address as set forth by EC Directive 2001/115 (Article 14 of Presidential Decree 445/2000).
For the invoice issue, the data provided by the Customer on order and order confirmation will be used. Delivery and any insurance will be charged to the Customer and are clearly stated in the order confirmation. Products payment will be carried out as chosen when ordering. No responsibility can be attributed to AA-Parts in the event of order delay or delivery delay.
Privacy & Security
Privacy and data security is guaranteed by the application of the Decree 30 June 2003, no 196 (as amended and supplemented) – of the Privacy Code and specified in the Privacy Policy. Transactions are made through servers of the Bank charged by AA-Parts of payments settlement, via PayPal or via bank transfer. No information on the transaction remains within the server or computer AA-Parts that can not be held responsible for any problems caused by that transaction.

Returns & Replacements
The right of withdrawal, in accordance with Art. 5 Decree No 22 May 1999 185 and Decree No 15 January 1992 50, allows you to return products purchased with the refund of the price except shipping costs. The right of withdrawal applies to individuals and thereby excludes purchases made by retailers and companies. Under Article. 5 paragraph 3) Decree 185/1999, the right of withdrawal does not apply to products customized at the express request of the customer.
To enforce the right of withdrawal the Customer will need to send, within 10 working days, a written communication to AA-Parts, Corso Sforza, 110 - 48010 Cotignola (Ra) Italy. The communication can be send within the same deadline using mail, telegram and fax provided that such communication is confirmed by registered letter with acknowledgment of receipt within 48 hours from its sending. Upon receipt of such notice of withdrawal, AA-Parts will quickly give instructions on how to return products. Such return must take place within the following 48 hours.
Anyhow the right of withdrawal undergoes the following conditions:
| - | the right applies to the purchased product in its entirety: it is not possible to withdraw only from parts of it; |
| - | goods must be returned undamaged and in their original packaging, complete in all its parts (including any documentation and accessory equipment); |
| - | in accordance with the law, shipping costs are charged to the customer; |
| - | shipping, until receipt acknowledgement in our warehouse, is under the full responsibility of the customer; |
| - | should the product be damaged during transport, the customer shall inform AA-Parts (by the following working day from receipt of the product), to enable us to make a timely complaint against courier and obtain the product refund (if insured); in this case, the product must be returned to AA-Parts, with shipping costs charged to the customer; |
| - | AA-Parts is not liable in any way for damage, loss or theft of goods returned with not insured shipments; |
| - | AA-Parts will refund the whole paid amount to the customer, within 30 days from the date of return shipment of the products, by sending banker’s draft payable to the Customer name stated in the purchase data or by sending money byPayPal.. |
The right of withdrawal will lapse, for lack of product integrity (packaging and/or its contents), should AA-Parts ascertain:
| - | absence of product parts; |
| - | the product is damaged for reasons not attributable to AA-Parts. |
Failure to meet what above stated to get the right of withdrawal, will lead to the return of the purchased goods to the sender and to the charge of the shipping costs by AA-Parts.
Ordering
The customer can buy products from the AA-Parts on line catalogue as they are described in the relevant information sheets. It is understood that the picture accompanying the description of a product can not be fully representative of its features but it may differ in colour, size, and accessories. All purchase support information are intended as mere general information, not necessarily to real features of a single product.
AA-Parts will confirm the correct order receipt through an e-mail reply, sent to the email address supplied by the customer. This confirmation message will contain an "Order Number" to be used in any further communication with AA-Parts. The message will include all data entered by the customer who agrees to verify the correctness and to communicate any corrections, as described in this document
Should AA-Parts unable to meet the Customer’s order, we will ensure timely notification.
Warranty
All products are sold by AA-Parts with a warranty under Decree Law of February 2nd, 2002, No. 24 - Implementation of Directive 1999/44/EC with the following rules, considering if the buyer is:
| - | a private (business to consumer B2C): The guarantee by law is valid for 24 months; |
| - | legal person, dealer, company or other (business to business B2B): The guarantee by law is valid for 12 months. |
To take advantage of it, the customer must keep the invoice he will receive with the purchased products.
Payment, Pricing & Promotions

Payments accepted are as follows:

For payments by credit card, at the end of the online transaction, the bank of reference will authorize only the amount of your purchase. For orders containing one or more products available "on demand", due to increased delivery times and to the credit card expiry date, payment will be charged on the card after notification to the customer of the expected delivery date and its acceptance by the customer.
Should the order be cancelled, either by the customer or by AA-Parts, AA-Parts will ask for the transaction cancellation and the release of the involved amount. The timing of release, for certain types of cards, depends exclusively on the banking system and can be up to their natural expiry date (24th day from authorization date). After the cancellation of the transaction, in no case AA-Parts can be held liable for any damages, direct or indirect, caused by delay in the failure to release the amount by the banking system. AA-Parts reserves the right to request additional information to the customer such as copies of IDs or other documents proving the ownership of the credit cards. Failure to fulfil such requests will give AA-Parts the right to refuse the acceptance of the order.
At no time, during the purchase process, AA-Parts will retain information about the buyer's credit card, sent via secure connection directly to the bank handling the transaction. Therefore no archive of AA-Parts will retain such data. In no case AA-Parts can be held responsible for any fraudulent or illegal use of credit cards by a third part, on payment of goods purchased on www.a-parts.com.
Pricing
Prices displayed on www.air-parts.com are inclusive of VAT.
For VAT, the following rules apply:
| - | identification of the customer's country of residence, as stated in the registration procedure; |
| - | Private Customer resident in Italy and in the European Union: the VAT rate is applied; |
| - | Italian Retailer or Company: the VAT rate is applied |
| - | Retailer or Company of the European Union: VAT rate is not charged to the customer – prices shown VAT included are therefore not the final prices for this kind of Customer; |
| - | customers outside the European Union: VAT rate is not charged to the customer – prices shown VAT included are therefore not the final prices for this kind of Customer; |
| - | private customer, dealer or company outside the European Union: VAT rate is not charged to the customer as set forth by art. 8 DPR 633/72 – prices shown VAT included are therefore not the final prices for this kind of Customer. Charges for customs clearance and customs duties for exports outside the European Union will be charged to the Customer. |
Promotions
Any special offers promoted by AA-Parts will be valid until products are in stock and in any case, are subject to actual availability of related products. Products given as gifts or special offer could be in promotional packs (e.g. packaging, online manuals, etc..)
If such special offer should include a free product along with one or more purchased ones, the customer will be entitled to such free product only if the same has been requested by the customer in the order sent to AA-Parts and until in stock. No service or replacement is provided for free products received by the customer.
